This webpage belongs to JBF – João Baptista Fernandes Lda, company number 514308761, hereinafter referred to as JBF. This privacy policy explains how we use the personal information on you that we collect upon your access to this website.

About this Privacy Policy

JBF respects your preferences regarding the collection and use of your Personal Data.

“Personal Data” means any information relating to an identified or identifiable natural person (“Data Subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

JBF respects your preferences regarding the processing of the collected Personal Data. This Policy (“Policy”) provides you information on how JBF collects and uses your Personal Data, software applications, social media and electronic messages, as well as marketing activities and offline sales (jointly referred to as “Communication Channels”).

Communication Channels may provide links to other platforms not belonging to JBF. Prior to providing your Personal Data, we encourage you to check the privacy policies of such websites, services, social media or applications.

What information do we collect about you?

We collect your information when you complete our online forms or when you make a purchase or query request. We also collect information on you when you deliberately send us your CV or when you contact us either by phone or by written.

The personal data are necessary for the purpose of your contact; thus, we process data such as name, address, phone number, e-mail address, subject, tax identification number (in case of business transaction) and identification number (in case of exercise of a right). Your educational background, for the purpose of job applications, is also processed. Upon providing your personal data, you authorize their collection, use and disclosure under the rules hereby set out.

We ask you not to send or share with JBF any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data, data concerning health or data concerning your sex life or sexual orientation.

The information on the use of the website is collected by cookies, but they don’t identify you specifically.

By granting information you are giving your informed and unequivocal consent that you agree to the processing of data concerning you in an automated manner.

Some of the data requested is required, and this is identified as such, and a lack of or inaccuracy in answers given may compromise the service provided.

How do we use your information?

The collected data are used to process your request and, if you agree, to send you by e-mail information regarding additional products and services we believe are in your best interest.

Although the collected information is privately processed by JBF – collected data will be used according to the general data protection regulation – throughout the whole processing process, we may need to privately transfer Personal Data to other entities, namely courts, and while processing your request, your data may be sent to external service providers (e.g. accounting services).

You have the right to lodge a complaint with a European supervisory authority regarding the protection of your Personal Data. JBF shall cooperate with the supervisory authority, providing all the information requested within the scope of its duties.

JBF only accepts the registration of users who are at least 16 years old. The Company Communication Channels are not intended to be used by underaged users. If you’re aware of a registration carried out by underaged person, we kindly ask you to notify us, so we can immediately remove it.

The recipients or categories of recipients of your Personal Data, depending on the contact option you used, are the Sales and Human Resources departments and/or the Managing Board. We will share your Personal Data with your consent or, as required, in order to complete any transaction or provide any service you requested. We also share the Data with business partners working on our behalf; when required by law or in order to fulfil legal procedures; to protect our clients; to protect lives; to maintain the security of our services; and to protect proprietary rights or those of JBF.

Marketing

We would like to send you information on JBF products and services that may be or come to be in your best interest. If you gave your previous consent, you can choose to cancel the subscription at any moment. Access and correction of your information

We need to ascertain the accuracy and reliability of the information we hold on you.

You have the right to withdraw their consent at any time, without compromising the lawfulness of the processing based on the previously given consent, as well as the right to request from JBF access to and rectification or erasure of their Personal Data and restriction of processing concerning the data subject or to object to processing as well as the right to data portability.

The preceding article doesn’t include the Personal Data needed to complete the contract in which the User takes part, to fulfil the legal obligations to which the Controller is subject and those needed for the purposes of JBF’s best interests.

Without prejudice to the legal or regulatory provisions to the contrary, Personal Data will be kept only during the minimum period necessary for the purposes that led to their collection or to their later processing, after which they will be erased or, in case it in the interest of JBF, processed for statistical purposes, subject to anonymisation, and it will not be possible to identify the Data Subject.

Where the controller intends to further process the personal data for a purpose other than that for which the personal data were collected, the controller shall provide the data subject prior to that further processing with information on that other purpose and with any relevant further information.

You have the right to request a copy of the information we hold on you. If wish to request a partial or full copy of the information held on you by JBF, please, contact us by mail to Rua Principal 66, Martinela 2420-025 Arrabal, Leiria.

If the User’s requests are evidently unfounded or excessive, namely due to their recurrent nature, JBF may, in line with the current legal framework, charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested or refuse to act on the request.

Cookies are intended to support the definition of the usefulness, interest and number of the website utilization, enabling a faster and more effective browsing and eliminating the need of repeatedly inserting the same information.

 

What type of cookies do we use?

There are two types of cookies that can be used.

Persistent cookies – stored at the browser level on your access devices (computer, mobile phone and tablet) and used whenever you return to one of our websites. Typically used to target the browsing towards the user’s interests, enabling us to provide a more customized service.

Type of Cookies

Candidates’ Personal Data Protection Policy

We will inform you that we will assess the application and will contact you if your profile matches with an open job vacancy.

The purpose of processing the Personal Data provided with the consent of the Candidate is to allow the execution of the application process for the function or area to which it applies or the process of managing spontaneous applications.

The legal basis for processing the Personal Data provided under the previous point is consent (art. 6º, nº 1, al. a) of the GDPR), and the candidate has the right to withdraw the consent at any time for the purposes described above. However, withdrawal of consent shall not compromise the lawfulness of the processing carried out based on the consent previously given.

The Personal Data of the Candidate for the vacancy for which he applied are kept for 5 years, in the case of a vacancy determined or for 1 year in the case of a spontaneous application, after which they are deleted or, if it is in the interest of JBF, anonymized in such a way that the Candidate is not or can no longer be identified.

The Candidate must submit new application after this period if he wants to continue to be in the recruitment files of JBF or send in writing (on paper or electronically) his consent so that it can continue to appear in the recruitment file after the mentioned period.

The recipients or categories of recipients of your Personal Data are the Human Resources department and Team Manager of the role or area you are applying for.

As a rule, the Personal Data transferred to JBF by the Candidate in the context of an application are not transferred to third countries. However, the data may be shared inside and outside the European Union when required by law or to respond to legal proceedings, to protect lives, to maintain the security of our services, and to protect property rights or JBF.

The recruitment process does not involve automated decision-making, including profiling.

No comparisons, interconnections, or other means of interrelating the information recorded shall be made.

By providing information, you are giving your informed and unmistakable consent to the processing of your data in an automated way.

We rely on the Candidate to provide us with accurate and complete information and to update the data in relation to any changes in the information provided.

In compliance with the established by the General Data Protection Regulation (GDPR) in Articles 15 and ff. concerning the Personal Data the Candidate has the following rights:

  1. Right of information and access to data that concern him.
  2. Right to rectification of inaccurate, incorrect, outdated, or incomplete data without undue delay by JBF.
  3. Right to erasure of the Data, without undue delay by JBF.
  4. Right to the limitation of the processing of the data concerning him in case of application of any of the situations described in art. 18th number 1 of the GDPR.
  5. Right to data portability.
  6. Opposition right to the processing of your personal data if they are not covered by legitimate cause, contractual or legal obligation provided for by law.
  7. Right not to be subject to automated individual decisions, including profiling.
  8. Right to withdraw consent when this is the lawful basis for processing the Personal Data.
  9. Right to be informed in the event of a breach of Personal Data, that is, a breach of security that causes, in an accidental or unlawful manner, the destruction, loss, alteration, unauthorized disclosure or access to Personal Data transmitted, preserved or subject to any kind of processing and where such breach is likely to pose a high risk to the rights and freedoms of the Candidate.
  10. Right to file a complaint with a European Union Supervisory Authority regarding the protection of Personal Data, JBF will assist the Supervisory Authority in providing it with all the information requested by the Supervisory Authority in the exercise of its powers.

The request to exercise the above rights must be made in writing and presented to JBF, through the postal address Rua Principal 66, Martinela, 2420 – 025 Arrabal, Leiria or by the e-mail address: rgpd@jbf.pt.

If the applications submitted by the Candidate are manifestly unfounded or excessive, due to their repetitive character, JBF may require the payment of a reasonable fee considering the administrative costs of providing the information or communication or taking the measures requested or refusing to comply with the request.

Further processing of the Personal Data for a purpose other than that for which the data were collected requires consent. Prior to this treatment, JBF provides the Candidate with information about this purpose and any other relevant information.

JBF only accept applications from candidates aged at least 16, who have completed compulsory schooling and who have adequate physical and mental skills for the job.

Security

JBF does not assume any responsibility when, for unrelated or unknown reasons, error occurs, damage, diffusion or unauthorized access arising from the transmission of electronic data that may occur between JBF and the Data Subject.

JBF applies appropriate technical and organisational measures to ensure a level of security appropriate to the risk of keeping candidates’ Personal Data on file.

JBF has a computer system capable of withstanding, at a given level of trust, accidental events or malicious or unlawful actions that compromise the availability, authenticity, integrity and confidentiality of the Personal Data stored or transmitted, and the security of related services offered or accessible through these networks and systems.
